What happened

On March 31, 2026, Trump signed Executive Order 14399, which orders DHS to compile a “State Citizenship List” for each state and send it to the chief election official at least 60 days before federal elections. The lists draw on citizenship, naturalization, Social Security and SAVE records, and DHS builds them through USCIS.

The order directs the Attorney General to prioritize investigating and prosecuting state and local officials who issue ballots to people deemed ineligible. It also authorizes withholding federal funds from noncompliant states where law allows. By July, the Justice Department had warned election officials of criminal exposure.

The order directs the Postmaster General to propose rules within 60 days under which the Postal Service would carry mail ballots only for voters enrolled on a USPS participation list. The rules would also require barcoded election envelopes. By August the administration was asking the Supreme Court to let the changes proceed.

Who benefited

The White House gained a federal citizenship list to press on states, a prosecution priority aimed at the officials who run elections, and a Postal Service gate on mail voting. DHS and the Justice Department expanded their reach into state election administration.

Who wanted something

Trump signed the order after months of posts demanding voter ID and an end to most mail voting “whether approved by Congress or not.” DHS’s election-integrity office under Heather Honey had been pitching SAVE checks to states. The order follows the SAVE America Act, which stalled in the Senate.

Who lost out

State and local election officials are now told the Justice Department will prioritize prosecuting them over ballot eligibility calls. Voters who rely on mail ballots could be dropped if absent from a USPS list. Naturalized citizens and others whose federal records are incomplete or wrong are also exposed.

Why it matters

One order touches who is on the rolls, who counts the votes, who gets federal money and whether a ballot can travel by mail. Each piece is contestable in court. Together they move the levers of a federal election toward the executive branch in an election year.
