Trump orders an end to birthright citizenship
An executive order directs agencies to stop recognising United States citizenship for children born in the country to mothers unlawfully or temporarily present whose fathers are neither citizens nor lawful permanent residents, applying to births 30 days after the order.
What happened
The order asserts that the Fourteenth Amendment “has always excluded from birthright citizenship persons who were born in the United States but not ‘subject to the jurisdiction thereof’.” It was never enforced: federal judges blocked it while challenges proceeded, and the Supreme Court struck it down on the merits in June 2026.
Why it matters
Citizenship at birth is set by the Fourteenth Amendment and a century of Supreme Court construction. An executive order that redefines who is born a citizen claims the power to alter the composition of the electorate by proclamation.
